START WITH YOUR CURRENT ARRANGEMENTS

Explain whether you are married, separating, already divorced, or discussing an agreement. Identify the date or period when circumstances changed and the arrangements currently in place. For parenting orders under the Divorce Act, section 16 directs the court to consider only the child’s best interests, giving primary consideration to physical, emotional, and psychological safety, security, and well-being. An individual family assessment should start with the children’s circumstances rather than a promised schedule.

PARENTING TIME AND DECISION-MAKING

Justice Canada’s parenting guidance distinguishes parenting time from decision-making responsibility for significant matters such as health and education. SUPPORT AND FINANCIAL INFORMATION

For a support question, identify the existing agreement or order and the income information already available. Keep tax returns, notices of assessment, pay records, and relevant business information organized by year. Tell counsel about changes in employment or income and the question you want addressed.

Note whether an item was owned before the relationship or acquired later, and identify any agreement dealing with it.

A list is a starting point, not a conclusion about how an asset or debt should be treated. Tell the lawyer about missing information and any proposed sale, transfer, or refinance. If family property and a real estate transaction overlap, provide both sets of documents so the advice can account for the connected questions.

Justice Canada’s parenting guidance emphasizes safety considerations where family violence is involved and the importance of considering related criminal or child-protection orders.
